SiTime Trade Compliance
Overview
SiTime product, including hardware, software, services, support and technology (collectively, “SiTime Products”) are subject to export and import controls administered by the U.S. government (including, but not limited to, the Export Administration Regulations under the U.S. Department of Commerce ("EAR”), U.S. Customs and Border Protection Regulations (“CBP”), and the Sanctions Programs administered by the Treasury Departments’ Office of Foreign Assets Control (“OFAC”), and other foreign jurisdictions.
Requirements
Exporters, distributors, customers, and users of SiTime Products are responsible for compliance with U.S. and local country export/import laws and regulations. Export, re-export, transfer, and use of SiTime products may require obtaining U.S. and local authorizations, permits, or licenses.
SiTime products may not be exported to individuals or entities listed on the U.S. Government Denied/Restricted Parties Lists or other applicable countries of export without first obtaining a license or other exception.
SiTime products may not be exported or re-exported to embargoed destinations, currently including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea Region of Ukraine.
End-User/End-Use regulatory restrictions must be reviewed in connection with (i) chemical, biological or nuclear weapons, (ii) rocket systems (including ballistic missiles and space launch vehicles), or (iii) unmanned air vehicles (including cruise missiles or drones) as detailed in Part 744 of the EAR, along with military end-user/end-use regulations, and export licenses obtained as required.
Policy
It is the policy of SiTime to comply with all export, import, and trade compliance laws in all countries in which it does business. Accordingly, strict adherence to these laws and regulations is required by every employee, contractor, business partner, and customer of SiTime and its affiliates.
Classification
Generally, most SiTime product is classified as EAR99, a basket designation for items that are subject to the jurisdiction of the EAR but are not described on the Commerce Control List with an ECCN.
